Terms of Service for Gearsy

1. Acceptance of Terms

By accessing or using the Gearsy platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform.

2. Description of Service

Gearsy provides an online marketplace that connects users who want to rent gear ("Renters") with users who have gear to rent ("Owners"). Gearsy is not a rental agent or insurer. We simply provide the platform to facilitate these transactions.

3. User Accounts

To use certain features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account.

4. User Conduct

You agree not to use the Platform to:

Violate any local, state, national, or international law.
Post content that is infringing, libelous, defamatory, obscene, pornographic, abusive, offensive, or otherwise violates any law or right of any third party.
Distribute viruses or other harmful computer code.
Harvest or otherwise collect information about others, including email addresses, without their consent.

5. Bookings and Financial Terms

Fees: Gearsy may charge fees to Renters and/or Owners for the use of the Platform. All applicable fees will be displayed prior to booking.
Security Deposits: Owners may require a security deposit for their items. Gearsy may hold these funds or place a hold on the Renter's payment method. Claims against the deposit are subject to our dispute resolution process.
Cancellations: Cancellation policies are set by the Owner or by Gearsy's default policies as displayed at the time of booking.

6. User Content

You retain all rights in, and are solely responsible for, the content you post to Gearsy. By posting content, you grant Gearsy a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the content in connection with the Platform.

7. Termination

We may terminate or suspend your account and bar access to the Platform immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

8. Disclaimers

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. Gearsy expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

In no event shall Gearsy, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Platform.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of [Your State/Country], without regard to its conflict of law provisions.
